Terms of Service.

These terms apply when you use idphotos.co.nz. They are written to be read, not to be survived. If something here seems unfair, email [email protected] and tell us.

Who you are dealing with

idphotos.co.nz is an independent New Zealand service making ID photos for passports, licences and other official documents. We are not affiliated with the Department of Internal Affairs, Te Tari Taiwhenua, Waka Kotahi, the New Zealand Police, or any other government agency. Contact: [email protected].

What you are buying

For $9.99 NZD, a one-off payment, you receive:

We are not GST registered, so no GST is charged and we cannot issue a GST invoice. The price shown is the price you pay.

What we do not promise

We cannot guarantee the agency you are applying to will accept your photo. Nobody can — not us, not a pharmacy, not a professional studio. The final decision is always theirs.

Our compliance check is an automated assessment against the rules the relevant agency publishes — passports.govt.nz for a passport, and the equivalent page for other documents. It is a well-informed opinion, not an official ruling, and it can be wrong in both directions. We recommend running your photo through the official photo checker before you submit your application.

The free reshoot promise

This is the promise we make instead of guaranteeing acceptance, and we will honour it.

If a government agency rejects a photo you bought here for a reason relating to the photo itself, email your rejection notice to [email protected] and we will reopen the booth for you at no charge — as many times as it takes to get one accepted. There is no time limit within 12 months of purchase, and no limit on the number of reshoots.

To be plain about it: the standard remedy is a free reshoot, not a refund. That said, if we cannot get you a photo that works, we will refund you — see below.

Refunds

We will refund your $9.99 in full if:

Because the product is a digital file delivered immediately, we do not offer change-of-mind refunds once you have downloaded your photo. The capture and the compliance check are free, and you see your photo and its verdict before paying — so you know what you are buying before you buy it.

Refunds go back to the card you paid with, via Stripe, usually within five to ten working days.

Your rights under New Zealand law

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are buying as a consumer. Those rights sit on top of everything written here, and we do not attempt to contract out of them.

Rules about editing — please read this one

New Zealand forbids using AI or digital editing to change how a person looks in a passport or other official ID photo. Our background cleanup is deliberately limited to the background: your face, hair, expression, glasses and clothing pass through untouched, and the instruction we give the model says so repeatedly.

You must not submit a photo to any government agency that has been edited to change your appearance, whether by us or anyone else. If you believe our cleanup has altered how you look, do not use it — tell us and we will refund you.

Using the service properly

When you use the booth, you agree that:

We may decline service to anyone abusing it.

Your photo stays yours

You own your photo and the files you download. You grant us only the limited permission needed to process the image in order to provide the service — assessing it and, if you ask, cleaning up its background. We do not store your photo, and we will never use it for marketing, training, or anything else. The details are in our Privacy Policy.

Availability

We aim to keep the service running, but it depends on third parties — our host, Stripe, and OpenAI — and it may be unavailable at times. Where an outage stops you receiving something you have paid for, the refund terms above apply.

Liability

Subject always to the Consumer Guarantees Act, and to the extent the law allows, our total liability arising from your use of the service is limited to the amount you paid us — $9.99. We are not liable for indirect losses such as delayed travel or missed applications.

That limit does not apply to liability we cannot lawfully exclude, including under the Consumer Guarantees Act and the Fair Trading Act.

Changes

We may update these terms. The version that applies to your purchase is the one published when you paid, and the date at the top of this page tells you which that is.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute — though we would much rather sort it out by email first.
